São Paulo, Brasil - For more than twenty years, Flavio Bolsonaro has served as a state or federal legislator. Under Brazilian federal law, all legislators have immunity from prosecution.
To run for President, Bolsonaro decided not to run for his Senate seat. Now, after losing the Presidential election, he no longer has legislative immunity when his Senate term expires in January 2027.
Many have already speculated that Bolsonaro could face prosecution for his connections to paramilitary gangs and various financial dealings.
In 2025, his brother Eduardo Bolsonaro fled Brasil and the Trump Administration granted him a green card in the United States to avoid prosecution. Recently, Eduardo Bolsonaro told a right-wing podcast host that he would also advise his brother to flee Brasil if he lost the Brazilian presidential election.
"If my brother doesn't win, I'm in favor of him leaving the country. Absolutely. Absolutely," said Eduardo Bolsonaro.
Now, a day after Flavio Bolsonaro lost the Brazilian presidential election, the Brazilian federal police have confiscated his passport out of fear that he might flee the country to seek asylum from the Trump Administration. Apparently, Flavio had been leaving a visit to his father, Jair Bolsonaro, who is under house arrest for attempting a coup after Lula lost the last election.
"This morning I went to visit my father; as you know, he is under house arrest. And when I was leaving, Lula's Federal Police were at his door, and in the middle of the street I was ordered to hand over my passports. I am also prohibited from leaving the country,” said Bolsonaro in a video posted to Instagram.
He complained that it was unfair to be asked to surrender his passport.
"This is a sign that our democracy has failed,” said Flavio Bolsonaro. “It was a decision made based on the election results, a political matter; it can't be like this. I never thought about leaving the country. I will hand over my passports and defend myself against this abomination, which is a clear attempt to intimidate me, but nobody will silence me”.
